Judge Leonie Brinkema has ruled that Google will not be forced to divest its AdX exchange or DFP assets following its ad tech monopoly conviction. Instead, the court has mandated behavioral remedies, including the requirement for Google to share real-time bid data with competing publisher ad servers.
The decision to avoid a structural breakup means Google maintains its end-to-end control of the programmatic ecosystem, a critical infrastructure for streaming services reliant on open-web display ads. By mandating data sharing instead of divestiture, the court is attempting to lower entry barriers for rival ad servers without dismantling the integrated DFP and AdX workflow. This outcome mirrors the recent search monopoly case, suggesting a judicial preference for behavioral constraints over corporate dissolution in complex tech markets. Streaming publishers should watch for the unsealing of the full order within two weeks to see the specific technical requirements for real-time data access.
The behavioral remedies imposed on Google's ad tech stack arrive amid intensifying competition in the programmatic ecosystem. In April 2025, the European Commission fined Google €2.95 billion for anticompetitive practices in ad tech, finding that the company had favored its own AdX exchange over rival platforms since at least 2014. The EU penalty, which came after a four-year investigation, required Google to cease self-preferencing conduct and submit a compliance plan within 60 days. That transatlantic regulatory pressure means Google now faces parallel behavioral obligations in both the U.S. and Europe, creating a de facto global compliance framework for its publisher ad server and exchange operations.
Google's legal strategy across its antitrust cases has consistently favored behavioral remedies over structural divestiture. In the separate search monopoly case, Judge Amit Mehta ruled in September 2025 that Google would not be required to sell Chrome, instead ordering the company to share search index data with competitors and end exclusive default agreements. The pattern of judicial preference for conduct-based remedies over breakups in complex platform markets has significant implications for the broader ad tech industry. Meanwhile, the U.S. Department of Justice under the current administration has signaled a narrower approach to tech antitrust enforcement, with officials emphasizing consumer harm over market structure concerns. This shift may explain why the DOJ's remedy request in the ad tech case focused on data-sharing mandates rather than the divestiture it originally sought.
The technical implications of mandatory real-time bid data sharing could reshape how competing ad servers interact with Google's infrastructure. The IAB Tech Lab published updated OpenRTB 3.0 specifications in early 2025 that standardize bid request and response formats across exchanges, providing a potential framework for how Google might implement the court-ordered data sharing. For streaming publishers running header bidding configurations, the ruling could reduce latency advantages that AdX historically held through its integrated DFP pipeline. Magnite reported in its Q2 2025 earnings that independent sell-side platforms gained share among top-50 publishers as advertisers diversified away from single-vendor dependency, a trend the behavioral remedies may accelerate.
