Spain Film Law proposal doubles streaming window to four months

The proposed extension to a four-month theatrical window would significantly delay the arrival of Spanish cinematic premieres on global streaming services. This shift prioritizes traditional exhibition revenue over rapid digital distribution, potentially cooling platform investment in local theatrical content. Within the broader European ecosystem, this move aligns Spain with stricter protectionist markets like France, signaling a regional trend toward longer windowing mandates. Industry observers should monitor the final vote in the Plenary and subsequent Senate passage to see if the 120-day requirement survives or if a compromise closer to the current 60-day reference is reached.

Spain's proposed four-month theatrical window would place it among the most restrictive markets in Europe for streaming platform access to new releases. France has long maintained a 15-month theatrical-to-streaming window for platforms that do not invest in local production, though a 2021 reform reduced that to 12 months for services committing at least 20% of French revenue to original content, creating a tiered system that rewards platform investment. Italy, by contrast, shortened its mandatory theatrical window to 90 days in 2021 and later allowed simultaneous releases for films with fewer than 50,000 admissions. Spain's current 60-day rule was already among the shortest in the EU, meaning the ERC proposal would represent a dramatic reversal rather than an incremental adjustment.

The political dynamics in Spain's Congress add uncertainty to the outcome. The ERC party, which introduced the amendment, holds limited seats and depends on coalition negotiations with the governing PSOE and its allies. The PP and Vox have both signaled opposition to extending the window beyond the current 60-day threshold, arguing that longer exclusivity periods harm consumer access and reduce the economic viability of smaller productions that rely on streaming revenue to recoup costs. The Spanish producers' association PATE has publicly supported the extension, citing declining theater attendance and the need to protect exhibition infrastructure in smaller cities.

The broader European trend toward longer windowing reflects growing tension between theatrical exhibitors and global streaming platforms over content investment and cultural sovereignty. The European Commission's 2024 Audiovisual Media Services Directive review recommended that member states maintain flexibility in setting national windowing rules, while acknowledging that overly rigid windows could discourage platform investment in local-language content. Netflix and Amazon have both increased their European production spending in recent years, with Netflix committing over €1 billion annually to European originals as of 2025, but industry analysts warn that mandatory local content investment quotas could redirect that spending toward markets with more favorable release terms. The outcome of Spain's Film Law debate will likely influence whether other southern European markets follow France's protectionist model or maintain shorter windows to attract platform capital.
