Major Indian telecommunications providers, including Reliance Jio, Bharti Airtel, and Vodafone Idea, are opposing a proposed TRAI regulatory framework that would mandate 21-day advance notice for new 5G network slices and impose strict cell-level congestion monitoring. The telcos argue that these requirements would stifle innovation, create operational burdens, and force the disclosure of commercially sensitive network strategies.
The pushback from India's largest telcos highlights a growing friction between net neutrality safeguards and the technical requirements of 5G monetization. If the regulator enforces strict pre-approval and congestion thresholds, it could limit the ability of operators to deploy dynamic services like Airtel's Fast Lane, which prioritizes specific traffic. This regulatory stance may set a global precedent for how governments manage differentiated service tiers without compromising general consumer access. The industry should monitor whether TRAI adjusts the 80% utilization threshold or the 21-day notice period in the final Quality of Service framework amendments.
Reliance Jio and Bharti Airtel have been among the most aggressive deployers of 5G network slicing commercially, which makes their opposition to TRAI's proposed framework particularly notable. In early 2025, Airtel launched its Fast Lane service in select Indian cities, offering users a paid priority lane for gaming and video streaming, marking one of the first consumer-facing slicing products in a major emerging market. Reliance Jio has similarly pursued enterprise slicing use cases, including dedicated network slices for manufacturing and logistics customers across its 5G standalone core. The GSMA has consistently advocated for lighter-touch regulation of slicing globally. In its 2025 policy position papers, the GSMA argued that network slicing should not be treated as a net neutrality issue and that pre-approval requirements would delay service innovation. The association's position aligns closely with the arguments Jio, Airtel, and Vodafone Idea have submitted to TRAI, suggesting coordinated industry lobbying at both national and international levels.
The regulatory debate in India sits within a broader global pattern of governments grappling with how to govern differentiated 5G services without undermining open internet principles. In the European Union, BEREC published updated guidelines in November 2024 clarifying that network slicing is permissible under the Open Internet Regulation provided it does not degrade general internet access quality. That framework avoids pre-approval mandates but requires transparency reporting, a middle ground that Indian operators have cited as a more workable model. South Korea's approach offers another contrast: the Korea Communications Commission approved SK Telecom's 5G slicing-based premium service tier in late 2024 without requiring advance notice filings, instead relying on post-hoc quality audits. These international precedents are likely to inform TRAI's final decision on whether to retain or relax the 21-day notice and 80% congestion threshold requirements.
On the technical side, the 80% cell-level congestion threshold that TRAI proposes has drawn scrutiny from network engineers who argue it is too low for dense urban deployments. A 2025 study by the Telecom Standards Development Society of India found that 5G cells in metro areas routinely operate between 70% and 85% utilization during peak hours, meaning the proposed threshold would trigger congestion alerts as a baseline condition rather than an exception. Vodafone Idea, which has the smallest 5G footprint among the three operators, has argued that compliance costs for real-time cell-level monitoring would disproportionately affect operators still building out coverage. The technical feasibility of monitoring at the granularity TRAI requires also depends on vendors' support for per-slice KPI reporting, a capability that Ericsson and Nokia have shipped in their 2025 software releases but which Huawei has not yet made available in the Indian market.
Reliance Jio, Bharti Airtel, and Vodafone Idea are opposing TRAI's proposed 5G network slicing regulations. The rules would require a 21-day advance notice for new service launches and mandate monitoring of cell-level congestion. Telcos argue these requirements stifle technical innovation and fail to account for dynamic network loading realities.
Reliance Jio, Bharti Airtel, and Vodafone Idea argue that the 21-day advance notice requirement and strict 80% congestion threshold mandate will stifle technical innovation and expose sensitive network strategies.
TRAI proposes that operators must take corrective action if a base station exceeds 80% Physical Resource Block utilization for five days in a month, a threshold telcos argue is too low for dense urban deployments.
Strict pre-approval and congestion thresholds could limit the ability of operators to deploy dynamic services like Airtel's Fast Lane, which prioritizes specific traffic for gaming and video streaming.
Operators have pointed to the European Union's BEREC guidelines, which avoid pre-approval mandates in favor of transparency reporting, and South Korea's approach, which relies on post-hoc quality audits.
