The Canadian government has rejected a U.S. trade demand to exempt major streaming platforms from local content and discoverability requirements. The dispute centers on the Online Streaming Act and Quebec's Bill 109, which mandate that foreign streamers prioritize Canadian and French-language content.
The rejection of U.S. demands signals that Canada will prioritize cultural protectionism over trade alignment, forcing platforms like Netflix and Amazon Prime Video to proceed with costly algorithmic reconfigurations. This stance reinforces a global trend where jurisdictions, including the EU, mandate local content quotas and financial contributions from foreign digital providers. For the broader ecosystem, this creates a fragmented regulatory landscape where global streamers must balance standardized user experiences against localized legal requirements for content promotion. Watch for the CRTC's final implementation of the 15% revenue contribution requirement, which remains a primary point of friction for U.S. platforms operating in the Canadian market.
The Online Streaming Act, which received Royal Assent in April 2023, has become a focal point for international trade friction. In early 2025, the CRTC finalized regulations requiring foreign streaming platforms to contribute 5% of their Canadian revenues to a fund supporting Canadian content production, a requirement that Netflix and Amazon Prime Video have publicly opposed. The U.S. Trade Representative's office has repeatedly flagged Canada's digital content mandates in its National Trade Estimate reports, arguing they constitute discriminatory barriers to U.S. services. The rejection of the last-minute U.S. demand during trade negotiations underscores how cultural policy has become a non-negotiable element of Canada's trade posture under Prime Minister Mark Carney's government.
Quebec's Bill 109 adds a second regulatory layer that compounds compliance complexity for global streamers. The Quebec legislation, passed in 2024, requires that French-language content be prominently featured and discoverable on streaming platforms operating in the province, effectively mandating separate algorithmic configurations for the province's 8.5 million residents. Meanwhile, the broader U.S.-Canada trade relationship has seen increased friction over digital services, with USTR Jamieson Greer signaling in March 2025 that the administration would pursue enforcement mechanisms against countries imposing local content requirements on American digital platforms. The EU's Audiovisual Media Services Directive, which requires 30% European content quotas on streaming catalogs, has served as a model that Canadian regulators have cited when defending their own approach.
Netflix has already begun adapting its Canadian operations to comply with the Online Streaming Act's requirements. The company announced in late 2024 that it would invest CAD 250 million over five years in Canadian original productions, a move that partially addresses the financial contribution mandate while sidestepping the more contentious discoverability provisions. Amazon Prime Video has taken a different approach, filing a legal challenge in Federal Court in January 2025 arguing that the CRTC's implementation of discoverability requirements exceeds the authority granted by the Online Streaming Act. The CRTC's final implementation timeline for the 15% revenue contribution requirement remains the next major milestone, with industry observers expecting compliance deadlines to fall in early 2026. Andrew Cardozo, a former CRTC commissioner, has argued that the discoverability provisions represent the most significant regulatory intervention in Canadian broadcasting since the original Broadcasting Act of 1991.
