Zayo pays $45,000 to settle AmeriCan-1 cable landing license investigation

This settlement underscores the FCC's low tolerance for administrative lapses in subsea infrastructure management, even for established cross-border links. For streaming providers relying on trans-Pacific or regional subsea capacity, the case highlights how ownership fragmentation among joint licensees like Zayo and Rogers can lead to critical regulatory oversights that jeopardize operational legality. The enforcement action serves as a warning to infrastructure owners that the Commission will prioritize formal compliance programs over simple fines when statutory deadlines are missed. Industry observers should monitor the pending joint renewal application filed in December 2025 to see if this settlement clears the path for long-term licensing.

The AmeriCan-1 cable system sits within a broader landscape of cross-border subsea infrastructure facing heightened regulatory scrutiny. The FCC has intensified enforcement of cable landing license requirements in recent years, particularly for systems connecting the United States to Canada and other allied nations. The Commission's enforcement actions have expanded to include compliance program mandates alongside monetary penalties, signaling a shift toward structural remediation rather than simple fines. Zayo Group, which operates the AmeriCan-1 system alongside Rogers Communications, manages a portfolio of terrestrial and subsea fiber assets across North America, making the compliance obligations particularly significant for its enterprise and carrier customers who depend on cross-border connectivity for video delivery and CDN traffic. The regulatory environment for subsea cable landing licenses has grown more complex as geopolitical concerns around foreign ownership and data security have intensified. The FCC's Team Telecom review process, which evaluates national security implications of submarine cable landing applications, has added layers of scrutiny beyond the basic licensing framework. For the AmeriCan-1 system specifically, the joint renewal application filed in December 2025 must navigate both standard FCC licensing procedures and potential national security review. The $45,000 voluntary contribution in this settlement is modest compared to penalties the Commission has imposed in other infrastructure cases, but the three-year compliance program requirement represents a more operationally burdensome obligation for Zayo and its joint licensees, including Rogers and Ledcor. Cross-border subsea cables like AmeriCan-1 serve as critical interconnection points for streaming video traffic between U.S. and Canadian networks. The system's Seattle-to-Vancouver route provides low-latency capacity that content delivery networks and streaming platforms use for cross-border content distribution. Zayo Group's broader network infrastructure supports major CDN operators and cloud providers, meaning any regulatory disruption to the AmeriCan-1 system could affect routing decisions for video delivery in the Pacific Northwest corridor. The FCC's insistence on formal compliance programs reflects the Commission's recognition that subsea cable operators must maintain continuous awareness of licensing deadlines, particularly when multiple joint licensees share responsibility for regulatory filings.
