Take-Two Interactive has filed federal subpoenas against Microsoft and Discord to identify individuals responsible for leaking unauthorized gameplay footage of Grand Theft Auto 6. The legal action, initiated under the Digital Millennium Copyright Act, seeks to protect intellectual property ahead of the game's upcoming November launch.
The aggressive use of DMCA subpoenas against major infrastructure providers like Microsoft and Discord signals Take-Two's intent to contain narrative and technical spoilers that could devalue its primary intellectual property. For the streaming ecosystem, the involvement of Netflix as an exclusive marketing partner for the upcoming preview highlights how gaming content is becoming a critical engagement tool for SVOD platforms. This legal maneuver aims to stabilize market sentiment following strong initial preorder performance reported by Strauss Zelnick. Industry observers should monitor the August 27 Netflix debut to see if the official reveal successfully shifts the public conversation away from the unauthorized leaks.
Take-Two Interactive has a documented history of aggressive intellectual property enforcement surrounding its flagship franchises. In September 2022, Rockstar Games confirmed that a hacker had breached its internal systems and downloaded early development footage of GTA 6, which led to the arrest of an 18-year-old in the UK. The company subsequently pursued criminal charges, and the hacker was sentenced to an indefinite hospital order in December 2023 after being found unfit to stand trial. That incident established the precedent for Take-Two's current legal posture: treating unauthorized distribution of pre-release content as both a civil and criminal matter. The subpoenas against Microsoft and Discord represent an escalation of that strategy, targeting platform infrastructure rather than individual uploaders.
The DMCA subpoena mechanism that Take-Two is using allows copyright holders to compel online service providers to disclose subscriber information without filing a full lawsuit. Discord updated its transparency reporting in early 2025 to disclose that it had received over 14,000 DMCA takedown requests in the prior year, a figure that reflects the platform's growing role as a distribution channel for leaked media. Microsoft, which operates GitHub where some of the leaked GTA 6 code reportedly appeared, has similarly faced DMCA subpoenas from game publishers. Take-Two's parent company reported net bookings of $1.37 billion for the quarter ending March 2025, with Strauss Zelnick emphasizing that GTA 6 preorders were tracking ahead of any prior Rockstar title. The financial stakes of protecting that launch window explain the company's willingness to subpoena two of the largest technology platforms in the industry.
The intersection of gaming content and streaming platforms adds another dimension to the GTA 6 leak situation. Netflix secured exclusive rights to debut the first official GTA 6 gameplay trailer in August 2026, a deal that industry analysts described as part of Netflix's broader strategy to use gaming IP as subscriber retention tooling. Scott Van Vliet, who leads Netflix's gaming division, has positioned the platform's gaming initiatives as complementary to its core streaming business rather than a standalone revenue line. The subpoena action against Discord is particularly notable because the platform serves as a primary community hub for gaming audiences, and Discord reported surpassing 200 million monthly active users in 2025, making it a critical vector for both legitimate marketing and unauthorized leaks. Take-Two's legal maneuver effectively forces these platforms to choose between user privacy norms and copyright compliance obligations at a moment when GTA 6 represents one of the most anticipated entertainment launches in years.
