NAB and FOX executives set 2027 FCC regulatory priorities for broadcasters

The upcoming policy debates signal a pivotal moment for media consolidation as the industry pushes for relaxed national TV ownership caps. These regulatory shifts directly influence how major players like FOX and Salem Media Group structure future M&A activity and technical investments. Within the broader streaming ecosystem, the focus on ATSC 3.0 and AI disclosure reflects a growing need for traditional broadcasters to align their regulatory frameworks with digital-first competitors. The outcome of these policy fights will determine the speed of next-generation broadcast adoption and the severity of enforcement for public interest obligations. Watch for specific FCC rulings on the 2022 Quadrennial Review as a primary indicator of the commission's appetite for further market consolidation.

The National Association of Broadcasters has been pushing the FCC to raise or eliminate the national television audience reach cap, currently set at 39%, as part of its broader deregulatory agenda. In early 2026, NAB filed comments urging the commission to modernize ownership rules to reflect the competitive pressure from streaming platforms, arguing that the cap artificially limits broadcasters' ability to compete with digital-first distributors. FOX and other major station groups have echoed this position, framing ownership deregulation as essential to sustaining local news operations and ATSC 3.0 investment. The Forecast 2027 session represents a public forum where these priorities will be articulated ahead of expected FCC action on the Quadrennial Review. ATSC 3.0 implementation remains a central regulatory battleground. The FCC has not yet mandated consumer device support for the standard, and broadcasters have repeatedly petitioned the commission to require ATSC 3.0 tuners in new televisions and streaming devices. The NAB and several station groups filed a joint petition in 2025 asking the FCC to adopt a phased tuner mandate, citing slow voluntary adoption by consumer electronics manufacturers. Meanwhile, Pearl TV, the consortium of major station groups including FOX affiliates, reported that ATSC 3.0 signals now reach over 75% of U.S. television households, though actual viewer adoption of compatible hardware remains low. The gap between signal availability and consumer uptake underscores why broadcasters view FCC intervention as necessary to accelerate the transition. On the AI disclosure front, the FCC under Chair Brendan Carr has signaled interest in transparency requirements for AI-generated content in political advertising, a move that would directly affect broadcasters' compliance obligations. The commission opened a proceeding in mid-2026 exploring whether AI-generated deepfakes in political ads should carry mandatory disclosure labels, with broadcasters and digital platforms potentially facing different standards. For NAB members, the challenge is navigating a patchwork of state-level AI disclosure laws while awaiting federal clarity. The Forecast 2027 session, featuring legal experts from Fletcher, Heald & Hildreth alongside NAB and FOX representatives, will likely address how broadcasters should prepare for divergent state and federal AI transparency regimes heading into the 2028 election cycle.
