FirstLine Films has released seven minutes of footage from the film 'As Deep as the Grave,' which features a generative AI-recreated performance of the late actor Val Kilmer. The production team utilized family archives and followed SAG guidelines for consent and compensation, and is currently pitching the film to streaming platforms as a model for ethical synthetic media.
This release marks a significant milestone in the commercialization of synthetic actors, providing a concrete case study for how independent studios can deploy high-fidelity digital twins on limited budgets. By adhering to SAG guidelines and securing estate consent, FirstLine Films is positioning the project as a low-risk entry point for streaming platforms wary of the legal and PR risks associated with generative media. The success of this pitch could encourage other estates to monetize deceased talent through similar licensing agreements. Watch for whether a major streamer acquires the film as a proof-of-concept for future AI-integrated productions.
The use of AI-generated performances of deceased actors has become a flashpoint for studios, unions, and streaming platforms alike. SAG-AFTRA has been actively shaping policy around digital replicas, and the union's 2023 contract established specific consent and compensation requirements for AI-generated likenesses of performers, creating the regulatory framework that productions like 'As Deep as the Grave' must navigate. Before his death, Kilmer partnered with Sonantic to create an AI-powered speaking voice when he reprised his role as Iceman in Top Gun: Maverick, demonstrating his own willingness to engage with synthetic voice technology during his lifetime. That prior collaboration with AI tools provides context for why his estate was receptive to FirstLine Films' approach. The regulatory landscape for digital replicas is tightening at the federal level. The U.S. Copyright Office concluded in its July 2024 report that a new federal law is needed to address unauthorized digital replicas, finding that existing state-level protections are insufficient given the speed, precision, and scale of AI-created likenesses. The report recommended a robust nationwide remedy covering both entertainment and political contexts. In April 2025, the Office released Part 2 of its AI report, maintaining that human authorship and creativity remain essential for copyright protection of AI-generated works, a determination that could affect how streaming platforms structure licensing deals for films built substantially on generative performances. On the technical and commercial side, the tools for creating photorealistic digital humans have advanced rapidly, with multiple vendors competing for entertainment industry contracts. Metaphysic formed a strategic partnership with CAA in January 2023 to develop generative AI tools for global talent and was named the sole AI provider for Robert Zemeckis' film 'Here,' which used hyperreal face replacement and de-aging on Tom Hanks and Robin Wright without additional compositing or VFX work. That talent-agency-vetted model contrasts with FirstLine Films' estate-driven approach but points toward a converging industry standard where consent frameworks and technical quality benchmarks will determine which synthetic actor projects streaming platforms are willing to acquire and distribute. To protect these creative assets, to ensure digital likenesses remain secure. As these tools evolve, to further protect studio assets. Furthermore, to ensure audiences can identify AI-generated performances. Recent , highlighting the ongoing challenge of synthetic content identification. To streamline these complex workflows, to assist studios in managing the technical pipeline.
