The Motion Picture Association and ByteDance have signed a Memorandum of Understanding to establish intellectual property guardrails for generative AI models, including Seedance and Seedream. The agreement aims to protect Hollywood likenesses and creative content across ByteDance's platforms, such as TikTok and CapCut.
This partnership signals a shift toward proactive licensing and protection frameworks between major studios and AI developers. By securing guardrails on Seedance, the MPA is attempting to avoid the friction seen with OpenAI’s Sora, which faced backlash for unauthorized character usage before its eventual cancellation. For the streaming ecosystem, this sets a precedent for how user-generated content platforms must manage generative tools that could otherwise dilute the value of premium IP. The deal suggests that tech giants are increasingly willing to trade some creative flexibility for legal certainty and industry cooperation. Watch for whether other AI video developers like Google or Runway adopt similar formal MOUs with rights holders to avoid protracted litigation.
The Motion Picture Association has spent the past two years building a policy framework around generative AI that now culminates in bilateral deals like the ByteDance MOU. In May 2024, the MPA and its member studios met with the U.S. Copyright Office as part of the agency's AI Study under Docket No. 2023-6, pressing for recordkeeping and disclosure requirements that would compel AI developers to document training data. That filing listed Netflix Studios, Paramount Pictures, Sony Pictures Entertainment, Universal City Studios, Walt Disney Studios Motion Pictures, and Warner Bros. Entertainment as the MPA's member studios. The ByteDance agreement extends this advocacy posture into a commercial arrangement, giving the MPA a direct enforcement channel rather than relying solely on regulatory rulemaking.
On the regulatory front, the MPA has consistently argued that existing copyright law is sufficient without new legislation, while simultaneously demanding that AI companies negotiate licenses. In March 2025, MPA CEO Charles Rivkin told the White House Office of Science and Technology that AI "can, and must, coexist with a copyright system that incentivizes the creation of original expression", pushing back against OpenAI and Google's calls for fair-use exemptions on training data. The MPA also opposed mandatory AI-labeling requirements for entertainment content, arguing such rules would conflict with First Amendment protections. The ByteDance MOU represents the practical application of this philosophy: voluntary bilateral agreements rather than government mandates. Separately, the Copyright Office's January 2025 Copyrightability Report concluded that prompts alone do not provide sufficient human control for copyright claims on AI outputs, a finding that strengthens the MPA's position that AI-generated likenesses of studio characters lack independent legal protection and must be governed through contractual guardrails like those in the ByteDance deal.
ByteDance's generative AI portfolio spans multiple consumer-facing products that the MOU must now cover. The company's Seedance video model and Seedream image models power features across TikTok, CapCut, and Dreamina, creating a broad surface area for potential IP infringement. , calling it "misguided" and citing post-production processes like de-aging and rotoscoping that benefit from AI. This tension between protecting studio IP from unauthorized AI replication while preserving studios' own ability to use AI tools in production is precisely the balance the ByteDance MOU attempts to strike. The deal's success will likely determine whether other AI video developers pursue similar voluntary frameworks or face the litigation path the MPA has historically reserved for uncooperative platforms.
